OVERVIEW

Welcome to Eliza Makes Shirts. "We," "us," and "our" refer to Eliza Makes Shirts LLC. We operate this store to bring you a shop where mom can say yes to everything — and your daughter gets to actually choose. This store is powered by Shopify.

These Terms of Service, together with any policies referenced here, describe your rights and responsibilities when you use our store. Please read them — they cover important things like warranties and liability.

By visiting or purchasing from our store, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the store.

SECTION 1 — ACCESS AND ACCOUNT

By using our store, you confirm you are at least the age of majority in your state or province, and that you have given consent for any minor dependents to use the store on devices you own or manage.

To purchase, you'll need to provide accurate billing, payment, and shipping information. You're responsible for keeping that information current and for all activity on your account. Accounts are non-transferable.

We do our best to show colors and product details accurately, but screens vary — what you see may differ slightly from what arrives. We don't guarantee that products will match exactly what's displayed.

Product descriptions are subject to change. We reserve the right to discontinue any product or limit quantities at any time.

When you place an order, you're making an offer to purchase. We reserve the right to accept or decline any order. Your order isn't confirmed until we accept it and process payment. Please review your order carefully before submitting — we may not be able to cancel once it's accepted.

Returns and exchanges are governed by our Refund Policy.

Your purchases are for personal or household use only, not for commercial resale.

Prices are subject to change without notice. The price you're charged will be the price shown at the time you place your order, as confirmed in your order confirmation email. Prices do not include taxes or shipping unless stated otherwise.

You agree to provide accurate payment information and authorize us to charge your payment method for all amounts due.

SECTION 5 — SHIPPING AND DELIVERY

All delivery times are estimates and are not guaranteed. Once your order leaves our fulfillment partner, it's in the carrier's hands. We're not responsible for carrier delays, customs processing, or events outside our control. Risk of loss passes to you once we transfer your order to the carrier.

SECTION 6 — INTELLECTUAL PROPERTY

Everything in this store — designs, graphics, text, images, the brand itself — is owned by Eliza Makes Shirts LLC or our licensors and is protected by copyright and intellectual property law.

You may browse and shop for personal use. You may not reproduce, distribute, or use any part of this store or its content commercially without our written permission. Eliza Makes Shirts LLC's names, logos, and designs are our trademarks. Don't use them without permission.

SECTION 7 — OPTIONAL TOOLS

We may provide access to third-party tools as part of the shopping experience. These are provided as-is, without warranty. Use them at your own discretion.

SECTION 8 — THIRD-PARTY LINKS

Our store may link to third-party websites. We're not responsible for their content, accuracy, or practices. If you leave our store to visit another site, you do so at your own risk.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify. All purchases are made directly with Eliza Makes Shirts LLC. Shopify is not responsible for any aspect of transactions between you and us. By using our store, you release Shopify and its affiliates from any claims related to your purchases.

SECTION 10 — PRIVACY POLICY

How we handle your personal information is described in our Privacy Policy. By using our store, you confirm you've read and understood it. Because we're hosted on Shopify, Shopify also collects and processes certain information as described in Shopify's own Privacy Policy.

SECTION 11 — FEEDBACK AND SUBMITTED CONTENT

We love hearing from our community — reviews, ideas, artwork, coloring pages, design submissions, contest entries, and anything else you share with us. Here's what you need to know about content you submit.

When you send us feedback, reviews, ideas, artwork, designs, coloring contest entries, or any other creative or written content ("Submitted Content"), you grant Eliza Makes Shirts LLC a perpetual, worldwide, irrevocable, sublicensable, royalty-free license to use, reproduce, modify, adapt, publish, distribute, display, and create derivative works from that content in any medium and for any purpose, including commercial use. This includes the right to incorporate submitted designs, artwork, and creative work into products, marketing materials, and brand assets without further compensation or attribution obligations.

This applies to all forms of Submitted Content, including but not limited to: written reviews, design contest entries, coloring page submissions, artwork inspired by our brand, photographs of products, and any other creative work submitted through our store, social media, email, or any promotion we run.

You confirm that you own or have all necessary rights to any content you submit, that you have the authority to grant us the license above, and that your submission does not infringe on any third party's rights. Where Submitted Content is created by a minor, the parent or guardian submitting that content on the child's behalf represents and warrants that they have the legal authority to grant this license.

We may, but have no obligation to, monitor, edit, or remove any Submitted Content that we determine in our sole discretion to be unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that violates any party's intellectual property rights or these Terms.

You agree that your Submitted Content will not violate any right of any third party, including copyright, trademark, privacy, or other proprietary rights. You may not submit content that is libelous, abusive, or unlawful, or that contains viruses or malware. You may not use a false identity or otherwise misrepresent the origin of your submission. You are solely responsible for your Submitted Content and its accuracy. We take no responsibility and assume no liability for any content submitted by you or any third party.

SECTION 12 — ERRORS AND OMISSIONS

Occasionally something slips through — a pricing error, a product description that needs updating. We reserve the right to correct errors and, if necessary, cancel orders affected by significant inaccuracies. We'll always try to communicate if that happens.

Use our store lawfully and respectfully. Don't use it to violate any law, infringe on anyone's rights, transmit spam or malware, scrape content, impersonate others, or interfere with the store's operation. We reserve the right to terminate access for violations.

Our store and products are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose. We don't guarantee uninterrupted or error-free service.

SECTION 16 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Eliza Makes Shirts LLC, its partners, affiliates, and service providers shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the store or any products purchased through it.

SECTION 17 — INDEMNIFICATION

You agree to indemnify and hold harmless Eliza Makes Shirts LLC, Shopify, and our affiliates from any claims, damages, or costs — including reasonable legal fees — arising from your breach of these Terms, violation of any law, or misuse of the store.

SECTION 18 — SEVERABILITY

If any part of these Terms is found to be unenforceable, the remaining sections stay in effect.

SECTION 19 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any part of these Terms doesn't waive our right to enforce it later. These Terms, along with our posted policies, constitute the entire agreement between you and Eliza Makes Shirts LLC.

SECTION 20 — ASSIGNMENT

You may not transfer your rights under these Terms without our written consent. We may transfer ours without notice.

SECTION 21 — GOVERNING LAW AND BINDING ARBITRATION

These Terms are governed by the laws of the State of Montana, without regard to conflict of law principles.

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms, our store, or any products purchased from us — including disputes about the formation, validity, interpretation, or breach of these Terms — shall be resolved exclusively through final and binding arbitration, rather than in court. You waive your right to a jury trial and your right to participate in a class action lawsuit or class-wide arbitration.

Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA) in effect at the time of the dispute, or such other arbitration body as we mutually agree. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Before initiating arbitration, you agree to first contact us at support@elizamakesshirts.com and give us 30 days to attempt to resolve the dispute informally.

Nothing in this section prevents either party from seeking emergency injunctive relief in court to protect intellectual property rights or confidential information pending arbitration.

If any part of this arbitration provision is found unenforceable, the remaining arbitration terms shall remain in effect to the maximum extent permitted by law.

SECTION 22 — HEADINGS

Section headings are for convenience only and don't affect the meaning of these Terms.

SECTION 23 — CHANGES TO TERMS

We may update these Terms at any time. The current version is always on this page. Material changes will be communicated as required by law. Continued use of the store after changes are posted means you accept them.
